1. Introduction

CheatChat respects the intellectualproperty rights of others and expects its users to do the same. As required bythe Digital Millennium Copyright Act ("DMCA"), CheatChat willrespond to notices of alleged copyright infringement that comply with the DMCAand other applicable laws. If you believe that content on CheatChat infringesyour copyright, please follow the procedure outlined in this policy to reportthe alleged infringement.

3. Filing a DMCA Notice (Notification ofClaimed Infringement)

If you believe that content on CheatChatinfringes your copyright, you must provide a written notice with the followinginformation as required by the DMCA (17 U.S.C. § 512(c)(3)):

  1. Identification of the copyrighted work you claim has been infringed, or, if multiple works, a representative list of such works.
  2. Identification of the material that you claim is infringing and that you request be removed or access to which is disabled, including the exact location (URL) on CheatChat where the material can be found.
  3. Your contact information, including your full name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature.

4. Counter-Notice (Response to a DMCATakedown)

If you believe that the content you postedon CheatChat was removed or access to it was disabled by mistake ormisidentification, you may file a counter-notice with our DMCA Agent. Thecounter-notice must include:

  1. Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
  2. Your contact information, including your full name, mailing address, telephone number, and email address.
  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the courts located in [State/City] if your address is outside of the United States), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
  5. Your physical or electronic signature.

If a valid counter-notice is received, wewill send a copy of the counter-notice to the original complaining party.Unless the original complaining party files a court action against you, we mayrestore the removed content or cease disabling access to it within 10-14business days after receiving the counter-notice.

5. Repeat Infringer Policy

CheatChat takes copyright infringementseriously. Users who are determined to be repeat infringers may have theiraccounts terminated. A repeat infringer is any user who has been the subject ofmultiple DMCA takedown notices, or whose content has been repeatedly removedfor infringement.

6. Misrepresentation of Claims

Under the DMCA, anyone who knowinglymisrepresents that content is infringing or that removed content is notinfringing may be liable for damages, including costs and attorney’s fees. Ifyou are uncertain whether material on CheatChat infringes your copyright, werecommend seeking legal advice before filing a DMCA notice.

CheatChat reserves the right to modify orupdate this DMCA Policy at any time. Any changes will be effective immediatelyupon posting on the App. Please review this policy periodically to stayinformed about our procedures for handling DMCA notices.
